- Workers Compensation: State
- The Texas Workers' Compensation Act
Texas enacted its first workers compensation law in 1913 and revised it in 1917. The 1917 law stayed in place (with amendments) until 1989. In 1989, in response to criticism of the 1917 law and its application, the Texas State Legislature enacted the Texas Worker's Compensation Act (the "Act") and added it to the Texas Labor Code. The Act took effect on January 1, 1991. Persons who suffer job-related injuries or illnesses in Texas may be entitled to compensation in accordance with the Act (if their employers carry workers compensation insurance; it is not required in Texas). The Texas Workers Compensation Commission provides online access to the Act.
- Workers Compensation: U.S. (Railroad Workers)
- Federal Employees Liability Act
Railroad workers who have suffered injuries or illnesses during the course of their employment may be entitled to compensation under the Federal Employees Liability Act (FELA). FELA generally gives injured seamen the authority to sue their employers to obtain compensation for their injuries. It is not "workers compensation" in the traditional sense, although it does provide limited "maintenance and cure" benefits regardless of the pendency or outcome of any suit. The Legal Information Institute of Cornell University provides online access to the Act.
- Workers Compensation: US (Maritime Workers)
- The Longshore and Harbor Workers' Compensation Act
Maritime workers who have suffered injuries or illnesses during the course of their employment may be entitled to compensation under the Longshore and Harbor Workers' Compensation Act. The Act covers maritime workers who are not considered "seamen." "Seamen" are generally persons employed on vessels or other movable structures who contribute to the vessels' or structures' functions or missions. The definition of "seamen" generally does not include a longshoreman, pilot, or other person who works on a stationary platform. Seamen may seek compensation under the Jones Act. Families of maritime workers killed on the job may be entitled to relief under the Death on the High Seas Act. The United States Department of Labor provides online access to the Longshore and Harbors Workers' Compensation Act. - The Jones Act
